Terms of Service

1. Acceptance

By accessing or using ClinikAPI (“Service”), you agree to these Terms of Service. If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization.

2. Service Description

ClinikAPI provides a managed healthcare infrastructure platform including:
  • REST API for clinical data storage and retrieval (FHIR R4 — 62 resource types)
  • TypeScript SDK for server-side integration (@clinikapi/sdk)
  • React component library for client-side UI (@clinikapi/react)
  • Developer dashboard for API key management, analytics, billing, and webhooks
  • FHIR R4 transformation engine with tenant isolation

3. Account Responsibilities

  • You are responsible for maintaining the security of your API keys
  • You must not share API keys or expose them in client-side code
  • You are responsible for all activity under your account
  • You must comply with all applicable laws including HIPAA when handling PHI

4. Acceptable Use

You agree not to:
  • Use the Service for any unlawful purpose
  • Attempt to access other tenants’ data
  • Reverse engineer or decompile the Service
  • Exceed rate limits through automated means
  • Store non-clinical data in FHIR datastores
  • Resell the Service without written permission

5. Pricing and Billing

  • Plans and pricing are listed at clinikapi.com
  • Paid plans are billed monthly or annually via Stripe
  • Overages are billed at $0.003 per request beyond your plan limit
  • Refunds are handled on a case-by-case basis

6. Data Ownership

  • You retain all rights to your data
  • We do not claim ownership of any clinical data stored through the Service
  • We act as a Business Associate under HIPAA for PHI

7. Service Level

  • We target 99.9% API uptime
  • Scheduled maintenance windows are communicated in advance
  • Status updates are available at status.clinikapi.com

8. Limitation of Liability

ClinikAPI’s liability is limited to the amount you paid for the Service in the 12 months preceding the claim. We are not liable for indirect, incidental, or consequential damages.

9. Termination

  • You may close your account at any time
  • We may suspend accounts for Terms violations with notice
  • Upon termination, your data is deleted within 30 days per our data retention policy

10. Changes

We may update these Terms with 30 days notice. Continued use after changes constitutes acceptance.
